Grievance Procedures FAQs

What should my grievance procedure include?

Your grievance procedure should clearly state who employees must contact, how to raise a grievance, time limits for each stage, the right to appeal, and how to handle disputes involving line managers or overlapping disciplinary matters.

Do I have to raise a grievance before going to an employment tribunal?

No. You’re not legally required to raise a grievance first. But tribunals may reduce compensation if you unreasonably skip the grievance process.

How soon must I hold a grievance meeting after a complaint is raised?

A grievance meeting should be held without unreasonable delay, ideally within 5 working days of receiving the complaint.

Do I need a written grievance procedure?

Yes. UK law requires employers to provide a written grievance procedure, typically in the employment contract or staff handbook. It must outline how grievances are raised and handled.

Can an ex-employee raise a grievance?

Yes, although it’s less common. You’re not legally obliged to investigate, but it may be wise to review the issue—especially if it could lead to a tribunal claim.
